month and the enrollment period
will take place over the next
two months.
In addition to Nissan/Infiniti,

Ohio Files Lawsuit Against Heartland
Refinery Group for Continued Public
Nuisance and Permit Violations |
Ohio
Attorney General Richard Cordray, at
the request of Ohio EPA, filed a
complaint and motion for preliminary
injunction against Heartland
Refinery Group on June 16th for
ongoing air pollution law violations
that are causing a substantial odor
nuisance and potential adverse
impact to public health and the
environment. The preliminary
injunction motion asks the court to
order Heartland to repair air
pollution control equipment required
by its air permit.
The state is asking the court to
issue a preliminary injunction
ordering Heartland to repair air
pollution control equipment. It also
asks to set a schedule to achieve
compliance with other terms and
conditions of its permit, perform
emissions testing, create a
facility-wide preventative
maintenance and malfunction
abatement plan and hire an
independent consultant to perform an
odor review. The state also is
seeking civil penalties of up to
$25,000 per day per violation.
